The law offices of Juroviesky and Ricci LLP have filed a class action lawsuit in the Ontario Superior Court of Justice against The Toronto-Dominion Bank (“Defendant”).

Specifically, persons who have maintained a bank account with Defendant and have (1) made one or more deposits into their bank account at any time between March 27, 2001 and March 27, 2007 AND (2) were not able to access their funds immediately upon such deposit because the Defendant held their funds, may be a Class Member in the above referenced action.

Juroviesky and Ricci LLP are seeking to pursue remedies against the Defendant for common law breach of contract, breach of common law duty/agency, conversion, unjust enrichment, and negligence.

Generally, the statement of claim alleges that the Defendant wrongfully withheld certain of its clients’ funds on deposit with Defendant, i.e. cheques, wire transfers, or other deposits, after the Defendant had already received payment on such deposit. (such payment received from the source or payor financial institution in respect of such deposit).

Note that the detailed statement of claim filed with the Ontario Superior Court of Justice is the result of an extensive and independent investigation conducted by Juroviesky and Ricci LLP.  To the knowledge of Juroviesky and Ricci LLP, no other statement of claim has been filed in this matter against Defendant and no other law firms, as at the time of filing its statement of claim, represent plaintiffs in this litigation.
