Important:
After conducting investigations and reviewing available evidence and relevant court orders Juroviesky LLP has determined that it is the best interest of the plaintiffs and the class to agree to dismiss the Car Conspiracy Class Action against all Defendants. On August 31st the court will be asked to approve a settlement agreement with each Defendant under which the plaintiffs will agree to dismiss the action and the Defendants will agree to forgo costs. A copy of the settlement agreement to be approved by the court can be viewed here. Settlement agreements for the Non-Honda Defendants will be in similar form with appropriate changes made where necessary.
Parties Agree To Schedule For Delivery Of Certification Materials
December 20, 2010
On December 13, 2010, the parties attended a case conference before the Honourable Justice Paul Perell to finalize the schedule for delivery of materials for the class action certification motion.
The Plaintiffs requested time to file additional evidence for the motion for certification. Justice Perell granted the Plaintiffs request and ordered the Plaintiffs to deliver their additional materials by January 31, 2011. Justice Perell ordered the Defendants to deliver their resposnding materials by March 21, 2011. The Plaintiffs will have the opportunity to deliver evidence in reply by May 9, 2011.
The parties agreed to a case conference following the delivery of materials, currently scheduled for May 16, 2011, to set a date for the Certification Motion and to address any new issues.

The lawsuit is still proceeding against Chrysler, General Motors, Ford, Honda and the Canadian Automobile Dealers Association.

Ontario Superior Court Approves Discontinuance of Class Action Against Nissan Canada Inc. and Nissan North America Inc. Defendants with Prejudice

On October 13, 2010, the Ontario Superior Court of Justice approved the dismissal of all claims alleged against Nissan Canada Inc. (“Nissan Canada”) and Nissan North America Inc. (“Nissan NA”) with prejudice and without costs, in the Class Action styled Tetefsky et al v GM et al (formerly Bester et al v. GM et at) (Ontario court file no: 07-CV-340633CP).

Ontario Superior Court Approves Discontinuance of Class Action Against BMW of North America, LLC and BMW Canada Inc. Defendants With Prejudice

The Ontario Superior Court of Justice approved today the discontinuance of all claims alleged against BMW Canada Inc. ("BMW Canada") and BMW of North America, LLC ("BMW NA"), with prejudice, in the Class Action styled Tetefsky et al v GM et al (formerly Bester et al v. GM et al) (Ontario court file no: 07-CV-340633CP).
Justice Perell approved the Plaintiff's motion for discontinuance after hearing evidence that Plaintiff's counsel had seen evidence that BMW Canada and BMW NA did not participate in the activities alleged in the Statement of Claim filed in the lawsuit.
