Class Action Against Canon Canada Inc.


Amended Statement of Claim

The offices of Juroviesky LLP would like to take this opportunity to update all interested parties as to the status of our Canon Class Action, Williams, et al. v. Canon Canada Inc., et al.

The Motion for Certification was heard, as scheduled, on September 12th, 2011 and all submissions concluded on September 14th, 2011.  Counsel for both sides made oral submissions to the court in support of their respective positions and answered any questions the court had.  The motion was open to the public. The Plaintiffs’ counsel sought to certify the action as a class proceeding on claims of breach of contract, breach of the Consumer Protection Act, breach of the Competition Act and waiver of tort.  The Plaintiffs’ counsel also moved to amend the Statement of Claim, which was permitted by the court on the second day of the hearing.  Accordingly, the updated Claim has been added to the website.

In addition to challenging both the Plaintiffs’ motions, the Defendants moved to strike certain expert evidence of the Plaintiffs, which was vigorously opposed by Plaintiffs’ counsel.

The Honourable Mr. Justice George Strathy of the Superior Court of Justice of Ontario, who presided over this motion, stated that he reserved judgment and would release his decision within approximately 90 days of the conclusion of the hearing. At the time our offices receive a written decision by the court, we will post it on our website by way of an update, as well as inform class members via email.

Juroviesky and Ricci LLP Files a Class Action Against Canon Canada Inc.

The law offices of Juroviesky and Ricci LLP have filed a class action lawsuit in the Ontario Superior Court of Justice against Canon Canda Inc. and Canon Inc. ("Defendants"), both are members of the Canon Group of Companies based out of Japan.

The suit claims damages for losses suffered by consumers that purchased popular models of Canon's digital cameras that are prone to suffer a malfunction with error code "e18". For further details please see the statement of claim on Juroviesky and Ricci's website www.jrclassactions.com

The class includes all purchasers of the specific camera models including the popular SD450, SD300, A75, and other camera models detailed in the statement of claim.

Juroviesky and Ricci LLP are seeking to pursue remedies against the Defendants for Negligence, Breach of Warranty, and other claims.

Note that the detailed statement of claim filed with the Ontario Superior Court of Justice is the result of an extensive and independent investigation conducted by Juroviesky and Ricci LLP. To the knowledge of Juroviesky and Ricci LLP, no other statement of claim has been filed in this matter against Defendants and no other law firms, as at the time of filing its statement of claim, represent plaintiffs in this litigation.
